Every case is different, an equal spilt is not always appropriate. Firstly we must check that all of the assets and income have been disclosed.

When considering the financial issues, a court is guided by a number of factors to including the well being of any children, earning capacity, assets and financial resources, financial needs, standard of living, age of each party and the length of the marriage, health of each party and conduct.

The Courts will always emphasis that a fair and reasonable outcome is achieved in regards to your circumstances.

You will need an emergency Court order to prevent your wife from relocating abroad. The Court will make a final decision about whether or not she can leave with your children. The Court will consider many factors which will include your existing relationship with your children and how this is likely to be affected if they move, as well as practical arrangements that your wife has put in place abroad relating to housing and schooling.
