LANDLORD & TENANT

DISPUTES REQUIRE THE RIGHT ADVICE
If you rent out your property or are a tenant who is renting, you may from time to time need to seek specialist advice regarding your rights and obligations.

Landlords require advice on a range of issues:

  • Recovery of rent arrears,
  • Breaches of covenants in a lease,
  • Options relating to termination of the lease for breach on the part of the tenant,
  • Eviction Notices,

Disputes also arise in relation to dilapidations to the property which is the subject matter of lease both during and at the end of lease term.

Tenants may require advice in relation to:

  • Failures by the landlord to honour their obligations under the lease,
  • To defend any claims brought by the landlord.

In the residential context, we act for both landlords and tenants in relation to recovery of rent arrears, possession proceedings under the Housing Act and associated enforcement of judgments and court orders obtained.

UNDERSTANDING THE LANDLORDS MENTALITY
We understand that landlords need revenue from their properties to earn a living because a property is a large investment which takes time to pay for itself. If a landlord has a problematic tenant who doesn't pay rent or causes expensive damage to the property it is understandable that they would turn to a legal expert for advice and litigation.

We do not make assumptions as to what landlords want. It may be that recovery of unpaid rent is the priority. It may be that possession as soon as possible is most important. Perhaps repairs or rent reviews are the main bone of contention. Either way we will work with clients to look for the quickest way of securing their investment.
